Before you file
Will I lose my house or car?
Usually not. Exemptions protect a set amount of equity in each, and Chapter 13 lets you catch up on missed payments. We check your numbers on the free call.
How do I know which chapter is right?
It mostly comes down to income, and whether you're behind on a house or car. Our guide to choosing walks through the four questions.
Will the calls really stop?
Yes. The automatic stay starts the day we file. Collectors who keep calling after that can be reported to the court.
During the case
Do I have to go to court?
Most clients only attend the meeting of creditors, which is often by phone or video. Your lawyer is with you either way.
Can I keep a credit card?
You have to list every card, but a card with no balance may stay open if the bank allows it. Most close them.
Will my spouse have to file too?
Not necessarily. One spouse can file alone, though their household income still counts toward the income test.
After discharge
How soon can I rent an apartment or buy a car?
Many clients do both within a year or two of discharge. A steady record of on-time payments after the case matters most.
Will it be on my credit report forever?
No. Chapter 7 stays for up to ten years and Chapter 13 for up to seven.
